1. Introduction and Acceptance of Terms
1.1 Agreement to Terms
Welcome to DARA ("Platform," "Service," "we," "us," or "our"). By accessing or using the DARA platform, mobile application, or any related services, you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
1.2 About DARA
DARA is a digital recovery platform designed to support individuals overcoming drug or alcohol addiction by connecting them with certified recovery coaches through paid voice or video sessions. The Platform also provides AI-based recommendations, progress tracking, and wellness tools.
1.3 Important Disclaimers
DARA IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL TREATMENT, EMERGENCY SERVICES, OR CLINICAL THERAPY. If you are experiencing a medical emergency or crisis, please contact emergency services (911 in the US) or your local crisis hotline immediately.
DARA provides coaching and support services, not medical or clinical treatment. Our coaches are certified recovery coaches, not licensed medical professionals unless otherwise specified.
1.4 Eligibility
You must be at least 18 years old to use DARA. By using the Service, you represent and warrant that you are of legal age to form a binding contract.
1.5 Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
2. Account Registration and Security
2.1 Account Creation
To access certain features of DARA, you must create an account by providing accurate, current, and complete information including:
- Full name
- Email address or phone number
- Password
- Any additional information required for evaluation or coach matching
2.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
2.3 Account Suspension or Termination
We reserve the right to suspend or terminate your account if:
- You violate these Terms
- You provide false or misleading information
- You engage in fraudulent, abusive, or illegal activity
- Your account poses a security or safety risk to other users or the Platform
2.4 Account Deletion
You may request account deletion at any time through the Platform settings. Upon deletion:
- Your personal data will be deleted in accordance with our Privacy Policy
- Unused premium sessions do not carry over and are non-refundable
- Session recordings and evaluation data will be permanently deleted after 60-90 days
- Coaches will lose access to your recovery records
3. User Roles and Responsibilities
3.1 Patient/User Responsibilities
As a patient or user seeking recovery support, you agree to:
- Provide accurate information during evaluation and onboarding
- Attend scheduled sessions or cancel with at least 24 hours' notice
- Communicate respectfully with coaches and platform staff
- Use the Service for its intended purpose (recovery support)
- Not use the Platform to seek or distribute controlled substances
- Not harass, threaten, or abuse coaches or other users
- Report any safety concerns or violations to DARA administrators
3.2 Coach Responsibilities
As a certified recovery coach on DARA, you agree to:
- Provide accurate credentials, certifications, and professional information
- Maintain professional boundaries and ethical standards
- Protect patient confidentiality and privacy
- Conduct sessions professionally and respectfully
- Update your availability calendar accurately
- Respond to client messages within reasonable timeframes (Premium clients)
- Report any safety concerns or ethical violations to administrators
- Not engage in any form of exploitation, harassment, or unprofessional conduct
3.3 Prohibited Conduct (All Users)
You may not:
- Use the Platform for any illegal purpose
- Impersonate another person or entity
- Share your account credentials with others
- Attempt to access another user's account without permission
- Interfere with or disrupt the Platform's operation
- Upload viruses, malware, or malicious code
- Scrape, harvest, or collect user data without authorization
- Use the Platform to promote competing services
- Record sessions without explicit consent (where required by law)
- Violate any applicable laws or regulations
4. Services and Features
4.1 Evaluation and Assessment
DARA provides intake assessment to help identify emotional and behavioral recovery needs. This assessment:
- Is not a medical diagnosis
- Should not replace professional medical evaluation
- Is used to match users with appropriate coaches
- May be updated periodically to track progress
4.2 Coaching Sessions
Session Types:
- Voice sessions (audio only)
- Video sessions (audio and video)
- In-app messaging (Premium users only)
Session Duration:
- Standard sessions are 30 minutes unless otherwise specified
- Coaches may end sessions early if safety or ethical concerns arise
4.3 Mood Tracking
Users can track their daily mood and emotional state. Mood data:
- Is stored privately in your user profile
- May be shared with your assigned coach to inform recovery support
- May trigger AI-driven insights and recommendations (Premium feature)
4.4 AI Recommendations (Premium Feature)
Premium users receive AI-driven insights based on mood patterns and evaluation results. These recommendations:
- Are suggestions, not medical advice
- Are based on patterns observed in your mood logs
5. Subscription Plans and Pricing
5.1 Free Plan
Free users can:
- Sign up and create an account
- Take the evaluation test
- Access mood tracking
- View AI-driven insights (limited)
- Pay per session to access coaching
Free users cannot:
- Message coaches between sessions
- Access unlimited AI insights
5.2 Premium Plan
Premium subscribers receive:
- 4 coaching sessions per month (voice or video)
- Unlimited in-app messaging with assigned coach
- Full AI-driven insights and recommendations
- Priority session scheduling
- Early access to new features
Premium Subscription Terms:
- Billed monthly on a recurring basis
- Sessions reset at the start of each billing cycle (every 30 days)
- Unused sessions do not roll over to the next month
- If upgraded mid-month, your 30-day cycle starts from the payment date
5.3 Pay-Per-Session
Free users can book individual sessions by paying per session. Session pricing is displayed at the time of booking.
5.4 Pricing Changes
We reserve the right to change pricing with 30 days' notice. Price changes will not affect active subscriptions until the next renewal period.
6. Payment Terms
6.1 Payment Methods
DARA accepts payment via:
- Credit/debit cards (Stripe)
- Google Pay
- Apple Pay
- Amazon Pay
6.2 Payment Authorization
By providing payment information, you authorize DARA to charge:
- One-time session fees (Pay-Per-Session users)
- Recurring monthly subscription fees (Premium users)
- Any applicable taxes or fees
6.3 Payment Processing
All payments are processed securely through Stripe. DARA does not store full credit card information on our servers.
6.4 Failed Payments
If a payment fails:
- You will be notified via email
- Premium access may be suspended until payment is resolved
- Unpaid sessions may be canceled
6.5 Billing Disputes
If you believe you have been charged incorrectly, contact us at support@dararecovery.com within 30 days of the charge. We will investigate and resolve disputes in good faith.
7. Cancellations and Refunds
7.1 Session Cancellation Policy
By Users:
- Cancellations made 24+ hours before the session: Full refund or session credit
- Cancellations made less than 24 hours before: No refund; treated as a no-show
- No-shows: Session is marked as completed and charged; coach is paid
Rationale: This policy protects coaches' time and ensures platform sustainability.
By Coaches:
- If a coach cancels, you receive a full refund or session credit
- If a coach is repeatedly unavailable, you may request a coach change
7.2 Subscription Cancellation
You may cancel your Premium subscription at any time:
- Cancellation takes effect at the end of the current billing cycle
- You retain Premium access until the end of the paid period
- Unused sessions at cancellation are forfeited (no prorated refunds)
- No refunds for partial months
7.3 Refund Policy
Non-Refundable:
- Completed sessions (including no-shows)
- Partial subscription months
- Unused Premium sessions at cancellation
Refundable:
- Sessions canceled 24+ hours in advance
- Sessions canceled by coaches
- Duplicate charges or billing errors
- Platform failures preventing session delivery
7.4 Refund Requests
To request a refund, contact support@dararecovery.com with:
- Your account email
- Session or transaction details
- Reason for refund request
Refunds are processed within 7-10 business days.
8. Coach Compensation and Payouts
8.1 Coach Earnings
Coaches earn $20 per completed session, regardless of whether the user is on a Free or Premium plan.
Completed Session Defined: A session is considered "completed" when:
- The session is conducted as scheduled
- The user does not show up (no-show)
- The coach marks the session as completed
8.2 Payout Threshold
Coaches must reach a minimum balance of $100 (5 completed sessions) before withdrawals are enabled.
8.3 Payout Schedule
Payouts are processed bi-weekly on the:
- 15th of each month
- Last day of each month (or next business day)
Even if you reach the $100 threshold mid-cycle, the payout occurs on the next scheduled payout date.
8.4 Payout Method
Payouts are processed via Stripe to the bank account you provide during onboarding. You are responsible for:
- Providing accurate bank details
- Updating information if bank details change
- Any taxes or fees associated with receiving payments
8.5 Failed Payouts
If a payout fails:
- You will be notified immediately
- Funds return to your accrued balance
- You must update your bank details
- Retry occurs on the next payout cycle
8.6 Platform Revenue Share
The platform retains the difference between the user's payment and the coach's $20 flat fee to cover operational costs, payment processing, and platform maintenance.
9. Coach Verification and Standards
9.1 Coach Application
To become a coach on DARA, you must:
- Submit an application with credentials and certifications
- Provide government-issued ID for verification
- Pass an admin review process
9.2 Required Credentials
Coaches must provide:
- Relevant training certificates (e.g., Addiction Counseling, Mental Health Coaching)
- Professional license or certification (if applicable)
- Proof of experience in recovery coaching or related field
9.3 Approval Process
Admin reviews all applications and may:
- Approve the application (coach gains dashboard access)
- Request additional information
- Reject the application
9.4 Ongoing Compliance
Coaches must:
- Maintain valid certifications
- Adhere to professional and ethical standards
- Update the platform if credentials expire or change
9.5 Coach Removal
DARA reserves the right to remove coaches who:
- Violate these Terms
- Receive repeated user complaints
- Fail to maintain professional standards
- Provide false credentials
10. Coach Assignment and Changes
10.1 Initial Coach Assignment
Coaches are matched to users based on:
- User evaluation results
- Coach specialization and expertise
- Coach availability
10.2 Coach Changes (Premium Users)
Premium users may request a coach change:
- Once per billing cycle (monthly)
- User must have no pending or booked sessions with current coach
- Evaluation report is transferred to the new coach
- Old coach loses access to user's data
- Unused sessions remain valid
10.3 Admin Overrides
Admins may override coach change limitations in special cases such as:
- Coach becomes unavailable or leaves the platform
- Safety or ethical concerns arise
11. Data Privacy and Security
11.1 Data Collection
DARA collects and stores:
- Personal information (name, email, phone)
- Evaluation and assessment data
- Mood tracking logs
- Session recordings (deleted after 60-90 days)
- Payment information (processed via Stripe)
11.2 Data Use
Your data is used to:
- Provide coaching and support services
- Match you with appropriate coaches
- Improve platform functionality
- Comply with legal obligations
11.3 Data Sharing
With Coaches: Your evaluation report and mood data are shared with your assigned coach to inform recovery support.
With Third Parties: We do not sell your data. We may share data with:
- Payment processors (Stripe)
- Service providers assisting with platform operations
- Law enforcement if required by law
11.4 Data Security
We use encryption and security best practices to protect your data. However, no system is 100% secure, and we cannot guarantee absolute security.
11.5 Session Recordings
Session recordings (if applicable):
- Are AI-monitored for safety and quality
- Are automatically deleted after 60-90 days
- Are accessible only to assigned coach, user, and admin (as needed)
11.6 Your Rights
You have the right to:
- Access your personal data
- Request data correction or deletion
- Withdraw consent for data processing (where applicable)
- Export your data
12. Intellectual Property
12.1 Platform Ownership
DARA and all related content, features, and functionality (including software, design, text, graphics, logos) are owned by [Company Name] and protected by copyright, trademark, and other intellectual property laws.
12.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial use in accordance with these Terms.

12.4 Prohibited Use
You may not:

- Reverse engineer or decompile the Platform
- Use DARA branding without authorization
13. Disclaimers and Limitations of Liability
13.1 No Medical Advice
DARA IS NOT A MEDICAL SERVICE. The Platform provides coaching and support, not medical treatment, diagnosis, or therapy. Always consult a licensed healthcare provider for medical advice.
13.2 Platform Availability
We strive to maintain platform availability but do not guarantee uninterrupted or error-free service. We may suspend or modify the Service for maintenance or updates.
13.5 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DARA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, data, or goodwill
- Damages arising from your use or inability to use the Service
- Actions or omissions of coaches or other users
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO DARA IN THE 12 MONTHS PRECEDING THE CLAIM.
13.6 Indemnification
You agree to indemnify and hold harmless DARA from any claims, damages, or expenses arising from:
- Your violation of these Terms
- Your use of the Service
- Your violation of any third-party rights
14. Dispute Resolution
14.1 Governing Law
